Terms of Service

1. Agreement and privacy

By accessing or using AM Review, you agree to these Terms. If you do not agree, do not continue using the service.

The Privacy Notice explains personal-data processing. Optional analytics and CE Tutor data sharing use separate controls and are not enabled merely by accepting these Terms.

2. Educational use; no professional engineering advice

Lessons, worked examples, calculators, simulations, quizzes, AI-assisted materials, and CE Tutor responses are for education and review. They are not signed-and-sealed engineering work, professional engineering services, or a substitute for professional judgment.

For design, construction, permitting, safety-critical work, procurement, or professional practice, verify the current law, code, standard, official issuance, and project requirements and obtain review by an appropriately licensed professional where required.

3. Local learner profile and records

Substantial portions of the learner experience are stored in your browser, including profile information, progress, assessments, preferences, offline resources, certificates, and data used by optional features.

• You are responsible for information you enter when accuracy matters.
• Local learner records are not identity or enrollment verification by AM Review.
• Local data may be lost if browser/site data is cleared, the device is lost or reset, or browser storage is evicted or corrupted.
• Use supported backup/export tools for learning records you need to preserve. Gemini credentials, CE Tutor conversations, and Gemini eligibility data are intentionally excluded from normal AM Review learning-data backups.

4. Adult-only Gemini BYOK eligibility

The optional CE Tutor uses Google Gemini through a pure bring-your-own-key design. Gemini BYOK is available only after the learner supplies a valid date of birth showing an age of 18+ and affirmatively accepts the current Gemini BYOK eligibility notice in Settings. The date of birth is used locally for this eligibility decision and is not sent to Google as Tutor context.

• You must enter your actual date of birth and must not use the Gemini integration if you are under 18.
• You are responsible for reviewing and complying with Google's current Gemini API terms, eligibility rules, API-key guidance, project restrictions, quota, and billing conditions.
• You must use only a Gemini API key and Google project you are authorized to use.
• Changing the saved date of birth or Gemini eligibility acknowledgement invalidates the prior CE Tutor opt-in and requires a fresh enable action.
• AM Review may disable or revise the integration if provider terms, audience requirements, security guidance, model/agent availability, or technical conditions change.

The DOB/18+ gate is an application eligibility control; it is not government identity verification and does not replace your obligation to comply with the provider's terms.

5. Gemini credential, model routing, transport, and usage

CE ships with no platform-owned Gemini key and no shared fallback credential. If you configure CE Tutor, the Gemini API key is saved in separate browser-only secret storage and requests are sent directly from your browser to Google using that key. AM Review does not operate a server-side Gemini proxy for this pure-BYOK feature.

CE Tutor uses direct Gemini generation only. The automatic priority is Gemini 3.8 Flash, then Gemini 3.7 Flash, Gemini 3.6 Flash, Gemini 3.5 Flash, and finally Gemini 3.5 Flash-Lite. CE Tutor does not use Antigravity as part of this routing policy.

When Google identifies a model-scoped daily quota as exhausted, CE may remember that non-secret model availability state for the current Pacific quota day and continue to the next configured model. Structured quota details are used when available to distinguish model-scoped limits from project-wide limits. Temporary model-scoped limits and selected transient provider errors may be retried with bounded exponential backoff and jitter before fallback; project-wide limits stop the ladder. Authentication, billing, permission, malformed-request, local-validation, consent, and protected-assessment failures are not intentionally multiplied across the model ladder.

You are responsible for provider charges, quotas, key restrictions, and account/project consequences associated with your credential. Google's production API-key guidance cautions against exposing API keys in client-side applications; pure BYOK intentionally keeps the learner's own key in the learner's browser, so you should use an appropriately restricted key and understand that browser storage is not hardware-backed secret storage.

6. CE Tutor context, images, and saved conversations

CE Tutor is opt-in. Page context, aggregated learning analytics, and limited learner-profile context are separately opt-in. The profile context permitted for Gemini is limited to display name, school, program, and year level; student number, identity IDs, profile images, and date of birth are not sent as learner-profile context.

You may explicitly attach bounded JPEG, PNG, or WebP images to a Tutor message. Those image bytes are sent to Google only when you send that turn. AM Review does not write attached image bytes into the local Tutor history database or normal learning-data backups. A later restored text conversation therefore does not restore a prior image, and you may need to attach it again for a follow-up that depends on the image.

Page-scoped Tutor text conversations may be saved locally on the device for continuity. Local retention does not authorize unlimited retransmission to Gemini: provider history remains separately bounded. Clear conversation deletes the current page thread; Remove AI chat deletes all saved Tutor threads, the saved Gemini credential, the AI eligibility record, and AI-sharing preferences while preserving unrelated learning data.

7. Protected assessments and acceptable use

CE Tutor is unavailable on integrity-protected assessment surfaces. You must not circumvent that restriction or any other access, safety, quota, or security control.

• Do not attempt unauthorized access to systems, accounts, administrative functions, non-public data, or infrastructure.
• Do not introduce malware, exploit vulnerabilities, interfere with availability, or impose unreasonable automated load.
• Do not use credentials, cloud projects, or quotas you are not authorized to use.
• Do not upload or submit images or other content you are not authorized to share with Google.
• Do not misrepresent assessment results, certificates, identity, accreditation, affiliation, authorship, or the source of AM Review materials.
• Do not use AM Review to facilitate unlawful, fraudulent, abusive, defamatory, or rights-infringing conduct.

8. Certificates and assessment records

Unless a specific program expressly states otherwise in writing, AM Review certificates and assessment records are informational records of activity within AM Review. They are not professional licenses, board-examination results, academic transcripts, degrees, government certifications, or institutional credentials.

No third party is required to accept an AM Review certificate. You must not alter or present a record in a way that falsely suggests accreditation, licensure, institutional endorsement, identity verification, or a result you did not obtain.

9. Intellectual property and third-party services

Original AM Review material is owned by or licensed to the AM Review operator unless otherwise stated. Third-party standards, trademarks, libraries, datasets, images, references, Gemini, hosting, analytics, and other services remain subject to their respective owners' rights, terms, privacy practices, availability, and security controls.

You may use ordinary platform features such as offline storage, printing, supported exports, and sharing links. These Terms do not transfer ownership of AM Review source material or authorize substantial republication as your own product or service.

10. Service changes, disclaimers, and liability

AM Review is an evolving project. Features, content, schemas, integrations, model/agent availability, and provider requirements may change, be corrected, suspended, or discontinued for maintenance, security, quality, legal compliance, provider changes, or product development.

To the maximum extent permitted by applicable law, AM Review is provided on an “as available” basis without a guarantee that every feature, question, answer, formula, simulation, AI response, recommendation, external reference, image interpretation, or cached resource will always be accurate, complete, current, compatible, available, or fit for a particular purpose.

To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of or inability to use the service, including loss of local data, user-supplied provider quota/charges, or reliance on educational or AI-generated content for professional work. Non-waivable rights remain unaffected.

11. Governing law and changes

These Terms are governed by the laws of the Republic of the Philippines, without prejudice to mandatory consumer, privacy, or other rights that cannot lawfully be waived.

The effective date and version identify this set of Terms. Material changes to provider routing, multimodal transfer, eligibility, credential handling, or other CE Tutor data practices may require a new acknowledgement before continued use.
